Article 1: General provisions
The e-commerce website of La Foret, a one-man business with its registered office at Opstal 50, 2650 Edegem, VAT BE0788.859.329, (hereinafter ‘La Foret’) offers its customers the opportunity to purchase products from its webshop online.

These General Terms and Conditions apply to any order placed by a visitor to this e-commerce website. When placing an order via the Kaat. webshop, the Customer must expressly accept these Conditions, thereby agreeing to the applicability of these Conditions to the exclusion of all other conditions. Additional conditions of the Customer are excluded, except when previously, in writing and expressly accepted by Kaat.

Article 2: Price
All prices stated are expressed in EURO, always including VAT and all other taxes or duties to be borne by the Customer.

If delivery, reservation or administrative costs are charged, this will be stated separately. The stated price refers exclusively to the articles as described verbatim. The accompanying photos are for decorative purposes and may contain elements not included in the price.

Article 3: Offers
Despite the fact that the online catalogue and the e-commerce website are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors or is not up-to-date. Obvious mistakes or errors in the offer do not bind La Foret. As for the correctness and completeness of the information offered, La Foret is only bound by an obligation of means. La Foret is under no circumstances liable in case of obvious material errors, typesetting or printing errors.

If the Customer has specific questions about e.g. sizes, colour, availability, delivery period or delivery method, we request the Customer to contact our customer service department in advance.

The offer is always valid while stocks last and can be modified or withdrawn by La Foret at any time. La Foret cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is subject to conditions, this will be explicitly stated in the offer.

Article 4: Online purchases
The ordering process begins on the website www.laforetbe.com. You order products, fill the shopping basket. You then go to the checkout, enter your e-mail details and approve the General Terms and Conditions. You enter your address details and a standard shipping cost indicated on the website. You can view the payment options. These are Credit Card and Bancontact.

After placing an order, the Customer will receive an email from La Foret to confirm that the order has been properly received, that the Customer’s money has been withdrawn from their payment account and what the reference number for the order is. However, this does not mean that the order has been accepted. The order is an offer by the Customer to La Foret to purchase a product. Each order must be accepted by La Foret and La Foret confirms such acceptance by sending an email confirming that the Product has been dispatched (hereinafter ‘Dispatch Confirmation’). The Contract does not come into effect until La Foret has sent the Dispatch Confirmation.
The Contract only covers the Products whose dispatch is confirmed in the Dispatch Confirmation. La Foret is under no obligation to supply any other Product that would have formed part of your order until we have sent a (separate) Dispatch Confirmation for it.
La Foret reserves the right not to accept the order if the Product is not available, if payment is not possible through the Customer’s payment account, or if La Foret detects an error to the Product or price. In these cases, La Foret will send you an e-mail confirming non-acceptance.

The Customer has the choice between the following payment methods):

  • via credit card
  • by bank card

La Foret is entitled to refuse an order due to a serious fault on the part of the Customer regarding orders involving the Customer.

Article 5: Delivery and execution of the agreement
Articles ordered via this webshop are delivered in Belgium/Netherlands.

Unless expressly agreed otherwise, the goods will be delivered to the Customer’s place of residence within 30 days of receipt of the order.

Any visible damage and/or qualitative defect of an article or any other shortcoming in the delivery must be reported by the Customer to La Foret without delay.

The risk due to loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods. However, the risk already passes to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice had not been offered by La Foret.

Article 6: Retention of title

The items delivered remain the exclusive property of La Foret until complete payment by the Customer.
The Customer undertakes, if necessary, to draw the attention of third parties to La Foret’s retention of title, e.g. to anyone who might come to seize items which have not yet been paid for in full.

Article 7: Right of withdrawal

The provisions of this article only apply to Customers who purchase items online from La Foret in their capacity as consumers.

If the right of withdrawal applies:

The Customer has the right to withdraw from the contract within a period of 14 calendar days without giving reasons.

The withdrawal period expires 14 calendar days from the day on which the Customer or a third party designated by the Customer, other than the carrier, takes physical possession of the good.

To exercise the right of withdrawal, the Customer must notify La Foret of his decision to withdraw from the contract by an unequivocal statement in writing. The Customer may use the attached model withdrawal form for this purpose, but is not obliged to do so.

To meet the withdrawal deadline, the Customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return or hand over the goods to La Foret, Opstal 50, 2650 Edegem, without delay and in any event not later than 14 calendar days from the day on which he communicates his decision to withdraw to La Foret. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.

The direct costs of returning the goods shall be borne by the Customer.

The Customer is requested to return the items in their original condition and packaging. If the returned item is somehow diminished in value, La Foret reserves the right to hold the Customer liable and claim compensation for any diminution in the value of the goods resulting from the Customer’s use of the goods beyond what is necessary to establish the nature, characteristics and functioning of the goods.

All returned items will be carefully examined. The principle here is that the consumer may only inspect the item as he would be allowed to do in a shop. Returned articles may be tried on, but must not have been used. If an article has suffered a decrease in value due to the Customer’s use, this will be charged to the Customer.

When withdrawing from the contract, La Foret may wait to be reimbursed until it has received back all the goods, or until the Customer has proved that he has returned the goods, whichever comes first.

Any additional costs resulting from the Customer’s choice of a mode of delivery other than the cheapest standard delivery offered by La Foret will not be refunded.

La Foret will refund the Customer using the same means of payment with which the Customer made the original transaction, unless the Customer has expressly agreed otherwise; in any event, the Customer will not be charged for such refunds.

The Customer cannot exercise the right of withdrawal for:

  • the supply or provision of goods or services whose price is subject to fluctuations in the financial market over which La Foret has no control and which may occur within the withdrawal period;
  • the delivery of goods manufactured according to the Customer’s specifications, or which are clearly intended for a specific person;
  • the delivery of goods that spoil quickly or have a limited shelf life;
  • the delivery of sealed goods that are not suitable to be returned for reasons of health protection or hygiene and whose seal has been broken after delivery;
  • the supply of goods which, after delivery, are by their nature irrevocably mixed with other products;
  • the delivery of newspapers, periodicals or magazines, with the exception of contracts for a subscription to such publications;
  • agreements concluded during a public auction.

Article 8: Guarantee
Pursuant to the Act of 21 September 2004 on consumer protection in the sale of consumer goods, consumers have legal rights. This legal guarantee applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.

To invoke the warranty, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods.

For items purchased online and delivered to the Customer’s home, the Customer must contact the Kaat. and return the item to Kaat. at his expense.

If a defect is detected, the Customer must inform Kaat. as soon as possible. In any case, any defect must be reported by the Customer within a period of 1 month after its discovery. Thereafter, any right to repair or replacement lapses.

The (commercial and/or legal) guarantee never applies to defects arising as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, non-compliance with the user instructions or manual, adjustments or modifications to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable delivery, are deemed not to be hidden defects, subject to proof to the contrary by the Customer.

Article 9: Customer service

Article 10: Penalties for non-payment
Without prejudice to the exercise of other rights available to La Foret, in the event of non-payment or late payment, the Customer shall be liable, ipso jure and without formal notice, to interest of 10% per annum on the unpaid amount from the date of the default. Furthermore, the Customer shall be liable, ipso jure and without formal notice, to pay a fixed indemnity of 10% on the amount in question, with a minimum of €25 per invoice.

Without prejudice to the foregoing, La Foret reserves the right to take back items that have not been paid for (in full).

Article 11: Privacy
The controller, La Foret, respects the General Data Protection Regulation and the Belgian Privacy Act of 30 July 2018.

The personal data communicated by you will only be used for the following purposes: the performance of the concluded agreement, processing the order, sending newsletters, advertising and/or marketing purposes. The legal grounds are: performance of the agreement, consent, fulfilment of legal and regulatory obligations and/or legitimate interest the company.

You have a legal right to access and possibly correct, supplement or delete your personal data. You may also ask to restrict the processing of your personal data in a number of cases listed in the AVG. You may also oppose the processing of your personal data if you have serious and legitimate reasons to do so that override our need to process your data. Via a written, dated and signed request to La Foret. Kalandeberg 9, 9000 Ghent, you can request your personal data in digital and readable form free of charge and/or have them transferred to other controllers. Insofar as our processing is based on your prior consent, you have the right to withdraw that consent.

In case of use of data for direct marketing: You may oppose the use of your data for direct marketing free of charge and do not have to provide a reason for doing so.

If any provision of these Terms and Conditions is declared invalid, unlawful or null and void, this shall in no way affect the validity, legality and applicability of the other provisions.

The failure at any time by La Foret to enforce any of the rights enumerated in these Terms and Conditions, or to exercise any right thereof, shall never be considered a waiver of such provision and shall never affect the validity of these rights.

Article 14: Modification of conditions
These Conditions are supplemented by other conditions explicitly referred to, and the general terms and conditions of sale of La Foret. In case of contradiction, these Conditions shall prevail.

Article 15: Proof
The Customer accepts that electronic communications and backups may serve as evidence.

Article 16: Applicable law – disputes
Belgian law shall apply, with the exception of the provisions of international private law on applicable law.

The courts of La Foret’s domicile have jurisdiction in the event of legal disputes.
